History
When timeshare started, it started as fixed weeks so the owners knew exactly when they could use their week, and it worked well. The industry then moved to a “floating” week based on a “first-come, first-serve” mentality, and has now moved to the “points” based system where the owner’s week is put in a trust and with a set amount of points assigned to that week.
The lifecycle of timeshare has now come to a point where many of the owners that have purchased over the years now have financial or medical issues that prevent them from both using and paying for their annual maintenance fees. When this started occurring, many of the timeshare companies were cognizant of the situation and were willing to accept a “deed-back” from the owner with little or no fee, which enabled them to re-sell the timeshare, and was a win/win situation.
Unfortunately, this situation gave rise to the timeshare “relief” or “exit” companies. Attorneys have ethical rules that prohibit direct solicitation of clients who have not sought legal services. The “relief” or “exit” companies have no such restrictions and solicited any timeshare owner they found in the public records, including the recorder’s offices of counties in resort communities. The timeshare resorts went from having a few dozen requests of termination a month, to hundreds or thousands a month. As a result, most timeshare companies now take a hard line with respect to terminations, and some simply refuse to respond without litigation.
Our Commitment
Our firm does not work for, or take referrals from, any timeshare “relief” or “exit” companies.
To be clear, our firm is not “anti-timeshare” and recognizes that some companies treat their owners extremely well. With this said, there are many companies which do not. The owners we represent have come to us to request our help to terminate their timeshare ownership based on a variety of reasons, including: financial, medical or claims of misrepresentation.
As a result of our commitment to not take referrals from “exit” or “relief” companies, we have developed trusted relationships with timeshare companies, and developed options for customers who own with companies that refuse to negotiate. We are selective with respect to the cases we take and as a result are highly successful in achieving the termination of the potentially never-ending timeshare obligations of our clients.
